TWO DAYS LATER... "DOZENS of off-duty Winnipeg police officers were left out in the cold yesterday after a judge refused them entry into a misconduct hearing that has been overshadowed by allegations of group intimidation.
Provincial court Judge Murray Howell made good on his promise to create a more "comfortable" courtroom atmosphere by only allowing about 20 spectators inside the Law Enforcement Review Act hearing. The crowd included about a dozen officers, along with a handful of reporters and members of the public.
Keith Labossiere, a lawyer representing the police service, tried to get Howell to open the doors to a huge crowd of officers standing outside in the hallway who had attended the first two days of the hearing only to be turned away yesterday.
He claimed such a ban violated the basic rights of the officers, who have come out in droves to support their colleagues and ensure "the process that judges them is fair."
...Howell refused, citing his own reservations and the concerns of the three men who have alleged they were viciously beaten by Winnipeg police officers in May 2002.

Fillion, Stranger and Chung claim they were attacked for no apparent reason inside an inner-city Winnipeg home by as many as eight officers. They have described a brutal beating, which included being repeatedly kicked, punched and struck with a gun and flashlights.
Doctors are expected to begin testifying tomorrow about various injuries the men sustained.
Fillion and Stranger were eventually released by police without being charged...
All three men filed complaints with LERA, the agency that investigates complaints against on-duty police officers. LERA then referred the matter to a judicial hearing, which is set to last two weeks.

Veteran Winnipeg Canada Police Officer Richard Norman Dow Arrested, Charged In Modeling Agency Scandal Involving Sexual Assaults And Exploitation
WINNIPEG, CANADA – A veteran Winnipeg police officer and former talent agent was arrested yesterday and faces numerous sexual assault and sexual exploitation charges after complaints from former clients at his modelling agency –some of whom were teenagers at the time.
For several months, the Winnipeg police professional standards unit — which investigates complaints against its own officers — has been looking into allegations made by former clients of the RiCoCo International modelling and talent agency that the agency’s owner, 52-year-old Richard Norman Dow, sexually assaulted them at photo shoots.
The investigation culminated yesterday with Dow’s arrest. The 18-year veteran of the police service, who had been performing administrative duties for the police, was released from custody yesterday on a promise to appear in court.
He faces 15 charges of sexual assault and five counts of sexual exploitation.

Police re-arrested and charged the male officer with 13 additional counts of sexual assault following a further investigation. The 52-year-old was originally arrested in September last year charged with 20 counts of sexual assault related offences.

Published: Friday, May 30, 2008WINNIPEG - A Winnipeg man with a long history of criminal convictions claims he was sexually assaulted and seriously beaten by as many as eight city police officers after being arrested earlier this month for breaking into an elderly woman's home.
Leon Vermette, 33, has filed a complaint with the Law Enforcement Review Agency and his lawyer, Martin Glazer, is calling for an independent investigation of Winnipeg police.
"I feel violated," a sobbing Vermette said Thursday after being released on bail.
Photographs document some of his physical injuries, including a fractured elbow, a bruised cheek, a torn toenail and a large cut to his head that required a staple.
Vermette claims the most painful and humiliating injury involved police shoving a piece of jewelry - he says officers told him it was a crucifix - into his rectum while his feet were shackled to a table and his hands cuffed behind his back.
"They said to me, 'Do you want to see how it feels to rape an elderly woman?'" said Vermette.

WINNIPEG, CANADA – A suspended senior police officer arrested four times for disobeying a court order barring him from contacting his former wife has been released on bail again.
Daryl Lee Evans, a 25-year veteran of the Winnipeg Police Service, was arrested and taken into custody last Wednesday after allegedly breaching a restraining order, his probation and conditions of his bail.
Evans was released again Monday on a $5,000 recognizance following an appearance before Judge Brent Stewart.
There is a publication ban on details of the bail hearing.
Evans was divorced last May, and his former wife filed for a restraining order in July. He was arrested that same month for breaching conditions of the order, and again in September and January. He was taken into custody each time and released on a $2,000 recognizance.
Evans pleaded guilty in October to one count of breaching the order and two counts of breaching his bail conditions. Four other charges were stayed. He received a one-year suspended sentence.

A day earlier, Evans surrendered to police after a warrant was issued to charge him with eight counts of breaching a protection order and seven counts of breaching his probation.

Members of United Against Racism say they constantly hear stories about aboriginal people being beaten by police or stopped by officers for no good reason.
Sandra Anderson has one of those stories. On a frigid January day, she stepped over to her window at work and saw two officers beat a native man.
"They had him on the ground and they were kicking him and punching him," shesaid.
Several other people in Anderson's office say they saw the incident too. They complained to police and an investigation was launched, but no charges were laid. Volunteers with video cameras will patrol certain parts of the city - areas where aboriginal people often complain about being stopped by police...a police spokesperson in Winnipeg says the program is unnecessary. Police Chief Jack Ewatski and the City of Winnipeg have finally agreed on a new contract that will see him stay on the job until December 2008 (He retired in scandal in 2007 but claims his retirement had nothing to do with the Driskell Inquiry and racism related murder scandals)
"I still feel I have something to accomplish in this role," Ewatski said yesterday. "There are more things I want to accomplish."
Ewatski, 52, said he wants to continue re-organizing the police service to make it more effective and efficient and work toward establishing new police buildings in the city's suburbs under the new four-district model.
"I'd like to be around to cut the ribbon," Ewatski said.
Currently, the 1,200-member police service is extending its community policing project to put more beat officers and traffic enforcement in more neighbourhoods. It is also expanding the arrest processing unit, which will reduce paperwork required of front-line officers. As well, plans are in the works to streamline management.

Chief provincial court Judge Ray Wyant refused on Tuesday to grant Const. William Anastacio a discharge for the 2002 assault, which means he will have a criminal record.
Wyant said Anastacio used an unacceptable level of force and violated the public's trust in police officers.
Anastacio arrested Chris Bartell in August of 2002 after his girlfriend called police. Bartell hurled racial insults against Anastacio during the ride to the city's homeless shelter.
After putting Bartell in a room used to sober people up, Anastacio asked a shelter employee whether it was monitored by cameras.
Crown attorney Marty Minuk told court that the constable then kicked Bartell in the chest and stomach and kneed him to the ground.
The employee complained to Anastacio's superiors.
Anastacio was later charged with assault.
"I assure you that this is not in my nature and something like this will never happen again," Anastacio told court Tuesday.
"I am a proud police officer and just hope to be able to continue my career."
Deputy Chief Menno Zacharias, who is filling in for police Chief Jack Ewatski, is scheduled to comment on the case Wednesday.
Anastacio's lawyer said he plans to appeal the sentence.

Grammy-nominated rapper and Christian minister Robert Wilson, known as Fresh I.E. in music circles, told the Free Press this morning that he and another man were driving in his car on Ellice Avenue near Donald Street Wedmesday afternoon when Winnipeg police boxed him in and removed him from the vehicle at gunpoint. While Wilson had his pockets emptied and was placed in a squad car and questioned, his friend was forced to the ground on the pavement in handcuffs by police.
An officer eventually gave into Wilson's repeated requests to look at his ID and insurance in the car, a Chrysler 300. That's when he said police realized they had made a mistake.
"He said 'we made a mistake, we typed in the wrong license plate,'" Wilson said, adding he believes police unfairly targetted him because he's a black man who was driving a valuable car.
"This is a case of racial profiling. They would never have done this if it was a senior couple that wasn't a minority in a nice car," he said.
"Not everybody who's a minority that drives a nice car is a thief," Wilson said.

WINNIPEG, CANADA - A city police officer has been charged with impaired driving in connection to a Sept. 20 car crash in which a car slammed into a tree.
Police said today the single vehicle accident happened at about 12:52 a.m. at the intersection of Bison Drive and Markham Road.
An off-duty officer was arrested.
Derek Zaporzan, 22, is charged with have care and control of a motor vehicle while impaired and have care and control over the .08 blood-alcohol limit.

WINNIPEG, CANADA – A Winnipeg police officer has been charged with drunk driving causing bodily harm after a motorcycle accident last month.
Investigators allege the officer was driving down McGillivray Boulevard east of Kenaston Avenue just after midnight on May 8 when the single-vehicle collision occurred.
The officer and his passenger were both taken to hospital with non-life threatening injuries.
Const. Daniel Gerard Aminot is charged with driving impaired causing bodily harm, driving over .08 and criminal negligence causing bodily harm.
Aminot is a two-year veteran of the police force.

An abuse of power, no matter at what level, is an offence against the community.”
Huynen, now employed as a sheet metal worker, declined to speak to reporters outside court. He now has a criminal record that prevents him from working as a police officer.
At a sentencing hearing last August, court heard Huynen was asked by a friend to use his “police contacts” to help another man, David Sokalski, track down his ex-girlfriend and a man who had stolen $460,000. “It is evident from these calls that … the purpose of these inquiries would, to any listener, raise a concern that harm might come to the individuals who took this money,” said lawyer Marty Minuk, acting for the Crown.Hymie Weinstein, Huynen’s lawyer, said his client thought he was helping his friend who was worried about criminal rumours involving his business partner.Weinstein requested Huynen receive an absolute discharge, arguing he had already been punished by the loss of his job and reputation.But Wyant rejected the request, saying a fine and criminal record would satisfy the court’s need to rebuke Huynen’s actions.

Police pulled over ex-cop 38-year old Ken Houston and Hells Angels 31-year old Billy Bowden in Houston’s Dodge Durango in the lane behind the 500-block of Corydon Avenue just before 3am Saturday.
Officers seized a loaded 9-millimetre semi-automatic handgun and a small amount of ecstasy.

James Allen Heickert, 44 - a full-patch biker from the Oshawa, Ont., chapter - is charged with conspiracy to commit murder against Sean Heickert, a resident of Thompson, Man., according to court documents obtained Thursday.

It may also explain why Sean Heickert was taken into custody this past weekend in Thompson after the shooting death of Hells Angels associate Bekim Zeneli. RCMP released him days later without laying any charges and say they simply wanted to "question" him.
No arrests have been made in Zeneli's killing and it's not clear what link, if any, may exist between his death and this case.
Sean Heickert, the alleged murder target, was only recently paroled after serving a lengthy prison sentence for manslaughter stemming from the death of an Ontario man in 1994. Heickert and two others killed a man whom they'd mistaken for his twin brother. Heickert believed the man had assaulted the mother of one of his co-accused.

Concerned , family sent fax to Winnipeg Police (rogue) Gang Unit (G/U) and RCMP stating they had found the above weapons and denotations of illegal police activity in association with Hells Angels…The G/U /vice/WPD broke into the home of the Anderson family and took by force with a "staged" warrant which claimed a registered informant said a sawed off shot gun was seen in the Anderson home on the kitchen table. But the only weapons found were the rifles the Andersons were waiting for the police to come and get with $4,500.00 in cash found in Mr. Andersons side pocket of his easy chair... which was for Brads funeral expenses.. but the police called it proceeds of crime. The lawyer representing Driskell and his mother Florence in a $20-million civil suit is claiming victory after Justice Shawn Greenberg on Wednesday denied motions to strike down major sections of their statement of claim.
It’s a decision that’s being referred to as a wake-up call for Crown attorneys across Canada.

The youth said she also called him a "blue-eyed fucking Indian." Hodgins told us she did not remember making the remarks attributed to her in the statement and denied making the racial slur.

Constable Cross was motivated to confront Harper primarily because of Harper’s race. That should never have been the case. We heard evidence from Melvin Pruden and Allan that officers directed racist comments at them. We heard evidence from a journalist who interviewed Const. Robert Cross that racist comments were made at the shooting scene and that subsequently a racist joke related to this shooting made the rounds at the Public Safety Building. The evidence is clear that racism exists within the Winnipeg Police Department. Including "Race" in Police Descriptions of Suspects (excerpt: " To advise police officers that a suspect in an offence is a (minority) is a license to commit racism. That should not be condoned. If officers were given proper descriptive details about such things as coloring, age, weight and hair length, they would avoid the kind of stereotyping that was at the root of the problem in this case") The City of Winnipeg Police Department Procedures and Reporting Manual addresses the use of race in describing suspects and states in Section XI, Media Liaison: D. Suspect Description Release Caution must be exercised when releasing descriptions of suspects to the media, so as not to malign specific ethnic or racial groups. This is most important when a suspect has been described by a witness as a member of a specific visible minority. Nothing in this policy is intended to prevent the use of specific facts which may assist in an investigation where the suspect has been positively identified as a member of a specific group, and the information is intended to appeal to a specific ethnic community for assistance. However, as a general rule, where a description is obtained from a witness indicating a specific visible racial or ethnic group, based on opinion of the witness, that description should be made in broad generic terms. The manual then gives various examples, one of which refers to Aboriginal people, and states: "Persons of North American Indian extraction including Metis should be described as: ‘Native in appearance.’" The guideline clearly is inadequate. The problem with using race, such as "native," in identifying a suspect is that the attention of the police officers is directed to Aboriginal people generally. There is strong evidence to suggest that merely describing someone by reference to race appeals to stereotypes held about that group. Asking police to search for a "native" calls upon officers to reach conclusions about how the person they are searching for looks, or talks or behaves. There is no commonality among Aboriginal people in their appearance, manner of speaking or behaviour. Mentioning a suspect’s race does little to assist the officers on the street, in our opinion. If they are to look for people with a certain skin colouring, then we believe that the description of the suspect’s complexion should suffice. Aboriginal people come in all shapes and sizes, and have skin colouring that can range from dark to fair. It seems illogical, therefore, to assume that by stating that a person is "native," one can conclude how that person looks. If a police officer is directed to look for a "native" male, the question arises: What type of person is he or she looking for? The facial characteristics of Aboriginal people are not sufficiently distinctive from those of other racial groups to justify the use of the category in police broadcasts. The retention of such a practice will continue to lead to situations, we believe, where Aboriginal people are confronted by police officers solely or primarily because of their race.

WINNIPEG - A man who was shot and killed by Winnipeg police was identified Wednesday as a former soldier with the Canadian Forces.
Police say Roy Thomas Bell, 44, confronted police officers as they responded to a 911 call at a Winnipeg apartment building Monday night.
Capt. Carole Brown, a military spokeswoman in Ottawa, told The Canadian Press that Bell served in the Forces from 1981 through 2004, when he worked as a postal clerk.
Bell was "never deployed on operations overseas," Brown said, adding that "when he was released, he was at the rank of corporal."
Brown said Bell joined the Princess Patricia's Canadian Light Infantry in 1981 and began working as a postal clerk 10 years later. Throughout his career, Bell moved all over Canada, working at bases including Winnipeg, Shilo, Trenton, Calgary, Wainwright, and Esquimalt.
Winnipeg police have not identified a possible motive for Monday's incident.
They say two officers were threatened by a man armed with a bat and a gun. According to police, they tried to use a Taser to subdue him, but it didn't work, so they were forced to shoot.
Police have declined to release many details about what happened.
The day after the incident, Sgt. Kelly Dennison said the officers were responding to a 911 call about a man threatening an acquaintance at an apartment block on Langside Street. As they approached the building, they were confronted by the armed man and felt threatened themselves.
Dennison said officers have to take appropriate action if they are confronted by armed individuals who could hurt them or others.
The two officers were not injured and have been placed on administrative leave, which is routine for Winnipeg police in such cases.

WINNIPEG - Aboriginal leaders in Manitoba want answers after police shot and killed a young native man this week, the second such death within a month.
Matthew Dumas, 18, was fatally injured Monday when police fired two shots during what they called "a scuffle" with officers in Winnipeg. At least one shot hit Dumas, who later died in hospital.
The dead man's stepfather, Leslie Dumas, wants to know why police were chasing him with their weapons drawn, as witnesses have alleged.
"They chase somebody down, you know, what are they going to do? Shoot first, ask questions later, you know," he said. "They must be trained to do something better than 'Bang! Ask 'em later.'"
Dumas was the second aboriginal Manitoban to die in a police shooting within a month. An RCMP officer shot and killed Dennis St. Paul in Norway House in early January after trying to arrest him for parole violations.

A Winnipeg police spokesperson told Amnesty International that the force responds to missing persons reports based on an assessment of the likely risk to the missing person and does not have a policy of waiting 48 hours for the person to turn up, as many in the public believe. However, the family says that the officers who took the report said they could not take action until another 48 hours had passed.... A family member comments: "When something happens to someone else's child, whether they are white or from any other kind of race or culture, the police do everything. She said after Kathleen's father's arrest on break and enter charges, the normally happy little girl became moody and depressed. Your two officers took it upon themselves to rewrite their version minus my one sentence and forge my signature. Unfortunately for them, their version of events can and will be proven fabricated.

Lawyers for the reporter and newspaper brought a motion to court to seal the confiscated items and quash the search warrants, stating that they were unconstitutional. The lawyers argued the SOIA does not define the term "secret" and that SOIA provisions criminalizing possession of "secret" government information without authorization were too broad-thus permitting the government to intimidate and arrest any reporter found possessing leaked government documents. The judge agreed and struck down the provisions. 5 plea bargains were offered amidst this torrent of threats as attempt at cohersion amidst terror towards false attest to guilt, with the threatened caveat of

It also stated my belongings were sent to Minneapolis in the U.S.
Several months earlier I had discovered a cyber frame up attempt upon me in the form of several radical Jihad/ Alqueada sites on line making reference to killing Bushites and using my url as their header!!!
Immediately conscious of a likely frame up attempt to manufacture false evidence and leverage that conveniently would be extraditable as felony conspiracy against U.S. officiates, I printed out and emailed the documents to Roch Tasse of International Civil Liberties Monitoring Group in Ottawa, and Michelle Gross of Communities United Against Police Brutality, in Minneapolis.
I suspected an abduction attempt would be forthcoming and I was quite correct in that it would come on Oct 27/07, in the form of rogue Canadian Law enforcement acting illegally on behalf of U.S. conspirators with designs towards our harm.
I had made the mistake of referencing having printed out this offensive framing material for evidence, on my tapped phone line, and so Winnipeg Police would have known to look for that document in particular in cinching their frame attempt amidst abduction!

As an attorney, Jill Clark has experienced first hand and heard directly from her clients about collusion between Hennepin County judges (including Chief Justice Lucy Wieland), the city attorney's office of Minneapolis, and prosecutors, including, but not exclusive to, annual social gatherings in Brainerd, MN at Maddens Bar - activities that in her judgment, violated the rights of her clients and further suggested to her that these problems were not isolated, but could in fact be affecting other people brought before the Hennepin County District Court. Consequently, Clark has gathered an array of court documents and audiotapes to support the existence of those problems, and reported them in two separate complaints with the Judicial Standards Board, one complaint with the Lawyer's Board of Professional Responsibility, and one lawsuit in federal district court. That's what Billy Fowler ofthe school board in Jena, Louisiana, said about those who have raisedconcerns about the sentencing imposed on six African American boys --ages 15-17 -- facing 100 years in prison.Outsiders are always what people in the South have called those whochallenge racism. But the story of Jena is not an outsider/insider story.It's a story about the worst tradition of what is known as SouthernJustice. And like in the days of Jim Crow, it's a story where any shadesof grey matter far less than black and white.The issue by now has become well known: discussed on CNN and in the pagesof USA Today.
At Jena High School, a black student received permissionfrom school authorities to sit underneath what was known as "thewhite tree" (remarkable that he felt he had to ask!) The next day,in retribution, three nooses hung from the branches, threats that theywould soon be harvesting "strange fruit." In protest blackstudents collectively decided to sit under the tree. This a bold and beautiful act in the spirit of the best traditions of the '60s. Theyrefused to comply with racist terror, even when those threats are asdrastic as being lynched for simply not staying in your place.And just like in the old South, the state made clear which side it wason. The town DA, Reid Walters, actually had the audacity to threaten onlythe black students, telling them that he had the power to ruin theirlives with the stroke of his pen if they continued to maketrouble.Tensions escalated over the course of the semester. Two black studentswere beaten by a white student while another group of black students werethreatened with a shotgun by a former classmate. Surprisingly, none ofthe white students or former students were punished in any way for theseincidents.But the following Monday when a white student was beaten up by six blackclassmates, they were immediately arrested and charged with attemptedmurder and conspiracy to commit murder, charges that would put them injail for 100 years without parole. The Jena 6 ranges in age from 15-17.The white student spent three hours in a hospital emergency room andrequired no further medical care.Mychall Bell was the first studenttried. He was represented by a public defender that called no witness,and was quickly convicted by an all-white jury, white judge, and nowfaces up to 22 years in prison.
Recently, in response to a public outcry about the case, prosecutors haveannounced that charges against Shaw and Jones had been reduced to lesserfelonies. But the need to be heard on this continues. Two other students,Robert Bailey Jr. and Bryant Purvis, still await trial for attemptedmurder. Bell's conviction has been allowed to stand even though the judgeruled he had been improperly convicted in an adult court when he shouldhave been tried as a juvenile.
Shaw and Jones still face years inprison.As Billy Hunter, the head of the National Basketball Player'sassociation, said:_ "The situation in Jena, Louisiana is abominableand rotten to the core. The actions of the District Attorney demonstratethat "racism and bigotry are live and well in Jena ." As aformer U.S. Attorney for the Northern District of California andAssistant Chief in the S.F. District Attorney's Office, it is my opinionthat the District Attorney's has severely overcharged the case revealinghis bias against the six black Jena youth.His actions should serve as awake-up call for all Americans who believe in an impartial and faircriminal justice system."This is a case that should outrage any individual regardless of the colorof their skin. When the justice system can be a direct symbol of racism,injustice and terror, the very moral fiber of our society is threatened.This is not a time for neutrality. Insiders and so-called outsiders willbe marching in Jena on September 20th. We will also be circulating astatement in the world of sports for those who choose to support theefforts to have the charges against the Jena 6 dismissed.

Many more cases pending or unsettled. The cases which Clark and Waite have won and for which they have fought are numerous and will be reviewed in a follow-up article. But they are cases by whose defense the two attorney's merit recognition and respect as defenders of Human Rights. Furthermore, Clark and Waite have been instrumental in holding police and courts accountable through their involvement in the federally mediated Police Community Relation Council, as well as pushing the Minneapolis City Council to recognize the Civilian Review Authority (CRA) as a legitimate authority in authorizing penalties for MPD brutality. These are some of the reasons why Blacklogic.blogspot.com has joined the broad coalition of Minneapolis community members as a supportive member of the Jill Clark Defense Coalition.According to the non-profit Council on Crime and Justice, Minnesota has the highest rate of over prosecution of Blacks in the nation.
VIOLATION OF ARTICLE 12(3): FAILURE TO PROTECT FROM RETALIATION
MN Human Rights Attorney Jill CLARK TARGETTED BY THE CORRUPT COURT FOR EXPOSURE OF THEIR JUDICIAL CRIMES HEREIN:
A retaliatory complaint filed on October 30, 2006 against Jill Clark with the Lawyers Professional Responsibility Board by Chief Justice Wieland, one of the judges whose conduct Clark had reported to the Judicial Standards Board, has been allowed to proceed to investigation, including the requirement that Clark submit a written response to the 28 allegations made by Justice Wieland against her. According to Peter Brown, a local attorney, member of the MN chapter of the National Lawyer's Guild, and a Jill Clark Defense Coalition supporter, conducted his own independent study ahead of an NLG meeting in February about Clark's situation. His study suggests that “given the timing of the judge's complaint to the Judicial Standards Board (October 30, 2006) and the fact that it complains about statements Ms. Clark made in her [earlier] April 11, 2006 complaint to the Judicial Standards Board and federal lawsuit filed April 25, 2006, the appearance of retaliation is created.“Until the issue of retaliation is forthrightly and thoroughly examined, the appearance is that a person who brought a complaint of human rights violations to appropriate authorities gets no hearing or investigation whatsoever, and a judge complained of subsequently files a counter-complaint and the wheels of investigation swing into action on her behalf. This, we believe, fits the profile of an impermissible retaliation against Jill Clark for complaining about human rights violations“In terms of the Declaration on Human Rights Defenders, the combined effect of the Judicial Standards Board's failure to act upon Ms. Clark's complaints and the Lawyer's Board of Professional Responsibility proceeding to process the judge's complaint against Ms. Clark, therefore, is an apparent failure to protect Ms. Clark from retaliation resulting from her legitimate exercise of her right to report activities that violate human rights, all in violation are Article 12(3).”According to Clark, it was the “alarming conduct of Judge Wieland” that led her, in April '06, to file a complaint with the Judicial Standards Board on behalf of her two young African American clients.Here are some examples from Clark's April '06 complaint letter:Many of you know that I vigorously represent clients of color who were mistreated by police, and are standing up against fabricated criminal charges filed by those police.Around Christmas 2005, Communities United Against Police Brutality called [the] Minneapolis police to ask that they preserve all video footage of an incident of reported police misconduct. As we often see in these cases, following the videotaped incident, both of the young Black men were faced with criminal charges.One of them, Rasheed Abdullah, asked me to represent him. This is the kind of case that I take, this is the kind of case that I have been successful with. Ask yourself who would not want me to be successful with these cases.Evidence shows that Judge Wieland took overt steps to keep me from being able to represent this young Black man, including:My January 10 appearance form notified Judge Wieland's chambers that I was coming onto the case of the loitering ticket for this young man if necessary, I was prepared to defend him by pointing up the misconduct of certain Minneapolis police officers.I gave the ticket number on that filing and faxed it to Judge Wieland's chambers.It turns out the City of Minneapolis hadn't filed formal charges on that ticket. It appears that after [italics Clark's] receiving notice that I was trying to come onto the loiter case, Judge Wieland's chambers contacted the prosecutor from the City of Minneapolis, on my case, to tell her to enter the ticket into the system. That would allow Judge Wieland to act on it. No one told me, the lawyer for this young man, that this was happening. No one sent me a copy of the email.Court was set for January 12.Someone from Judge Wieland's chambers told the Minneapolis prosecutor to come 15 minutes before I was due to arrive. T* o date no one has said what transpired in those 15 minutes (BL)On January 12, even though Judge Wieland knew that I was representing the young man on this loiter case, she had conversations in her chambers with the City prosecutor, without me present.I arrived early to review the court file (which by the way I got from Judge Wieland's chambers), and I was sitting in the courtroom know knowing they were in the chambers. During that time, government lawyers were talking about my case in Judge Wieland's chamber's, just down the hall, and no one came to get me in the courtroom.By the time I learned those lawyers were there, it was clear that they had already met with Judge Wieland about the case(s).When I went back to chambers and questioned what was going on, rather than including me in the chambers discussion, Judge Wieland tried to physically close her chambers door on me, to prevent me from going into chambers, where there had been discussions about my case. She resorted to physical conduct against me, instead of legal process, in order to keep me from coming into her chambers to discuss my case.When it became clear that Judge Wieland would not allow me into her chambers, I was unwilling to resort to physical force to push my way into her chambers. But I demanded that if they talked without me, that I wanted a record. Judge Wieland told everyone to return to the courtroom, which I did. But once I got there, no one else came.When I went into the back hall to see what had happened, attorneys were walking down the hall toward the courtroom and Judge Wieland was bringing up the rear. Judge Wieland told those attorneys that she wanted to “talk to Ms. Clark on a different matter.” Then alone in the back of the hall, just her and me, she got physically close to me and she threatened me about the case of Ali Dunham v. the Wayzata Country Club. That interaction was memorialized in my March 27, 2006 letter to Judge Wieland. [Copy provided with attachments A (my contemporaneous notes) and B]. In my opinion she was trying to intimidate me, under threat of filing an ethics charge on me, from doing my job.Because of these and similar events, Clark believes Judge Wieland was trying to prevent her from representing Rasheed Abdullah on a case that she already knew involved allegations of videotaped police misconduct. The aforementioned facts were put into a complaint to the Judicial Standards Board in April 2006, with an clear statement, Clark says, that I had more evidence and transcripts in my office.“What was I supposed to do, stay silent,” Clark asked at a press conference held December 12, 2006 at the Hennepin County Government Center, shouting distance from Judge Wieland's chambers.FODDER FOR DISCUSSION OR A CALL FOR COMMUNITY ACTION?According to Clark, no one from the Judicial Standards Board ever contacted her about that additional evidence; rather, she got a letter dated May 23, 2006, that stated that there was “insufficient evidence to sustain your complaint or proceed to a public hearing.”She wrote back a letter dated May 25, 2006, questioning how that conclusion could have been made, since she was never contacted to obtain the evidence that she already had in her office.In a letter dated July 18, 2006, David Paull of the Judicial Standards Board told Clark that the Board had reviewed “a number of witness statements” and other documents. However, Clark says that when she talked to Paul on December 4, he said he doesn't take “statements,” he takes notes, and then writes paragraphs. Clark claims she was told the Board's review of complaints is “as loose as can be,” and it decides whether or not it “wants” to pursue the case further.Neither Clark nor the other complainants believe they really know what happened to their April '06 complaint What is certain is that Judge Wieland is using the inaction of the Judicial Standards Board against Clark.Prior to learning of Judge Wieland's October 26 complaint, in September and October 2006 Clark filed another complaint with the Judicial Standards Board, complaining about Judge Wieland's involvement in what Clark believed was a matter of pubic concern.Clark filed a parallel copy with the Office of Lawyer's Professional Responsibility, asking that they investigate whether a lawyer was involved in that situation involving Judge Wieland.About a month later, on October 26, Judge Wieland filed a complaint letter against Clark with that same legal office, claiming, apparently, that Clark violated her ethical rules by complaining against her. It is at this point that Clark had her Eureka moment, and believes without a doubt that Judge Wieland filed her October 26 complaint to retaliate against her, in hopes of intimidating her into silence.A copy of Judge Wieland's complaint against Clark is unavailable because it contains confidential information about a juvenile client of hers, without his permission.Ironically, the Office of Lawyer's Professional Standards decided not to investigate the lawyer's conduct that would have implicated Judge Wieland, but has decided to investigate her. The police are the criminals and they belong in jail! They are instigating violence in peaceful events like the bicycle riders.
Everyone needs to demand that these criminal police actions come to a stop! What is going on? New World Order from Hell? Is this what North America Union will be? I read stories of Winnipeg Police kidnapping women,driving them to the out skirt of town, raping them and then maked their victims walk back with no shoes and threats not to talk our else!
